Considering Hiring a Different Agent? Here's What You Need to Know header image.

We understand that selling or buying a home can be a big decision, and sometimes, you may find yourself questioning if your current agent is the right fit for you. Today, we'll discuss some considerations and action steps you can take if you feel the need to explore other options.

Remember, it's essential to find an agent who truly prioritizes your needs and goals and who communicates in a way that you understand and appreciate. Let's dive in!

Communication is Key:

Often, issues with agents can be resolved through better communication. If you're facing challenges, try discussing your concerns with your agent openly. Clear communication can lead to better understanding and cooperation.

Your Options:

If you've done what you can to resolve any particular issues in the communication department and ultimately decided you want to explore other possibilities, here are your basic options (this assumes you have a current and valid listing or buyer agreement):

  • Option 1: Speak with the broker: Reach out to the broker your agent works through and inquire if another agent within their brokerage might be a better fit for you. Remember, your contract is with the brokerage, not just the agent. The broker only knows there is a problem if you bring it to his or her attention.
  • Option 2: Wait until the contract expires: If you're under contract with your current agent, you may need to wait until it expires to make a brokerage change. Be aware that if communication is an issue, it might not improve during the contract-to-close phase and once your home is under contract, it’s much harder to make brokerage changes.
  • Option 3: Request an early release: You can ask your agent and broker for an early release from the current contract to hire someone who will better serve your needs. The broker will have the final say on giving you a release.

Document Your Communications:

Regardless of the option you choose, it's crucial to document all communications, attempts to resolve issues, and any new agreements or cancellations you negotiate.

Cancellation of Listing Agreement:

If you decide to request a cancellation or early release from your listing agreement, do so in good faith and document your concerns and previous attempts to address them. If there are costs associated with cancellation mentioned by your agent or broker, verify they were spelled out in your contract. Do your best to approach the request from a win-win perspective, and ensure that all agreements are put into writing.

Changing Agents for Home Buyers:

In most states, home buyers are under no obligation to a specific agent unless they have a written contract. If no contractual arrangement exists, changing agents is as simple as notifying the agent you've been working with that you no longer require their services. FYI: This is a matter of courtesy and not contractual obligation. But if you do have a contract, remember that the broker has the final say in whether to voluntarily cancel the contract or release you from it.

Important note: 

If you enter into a legal contract of any type, it’s important to read the contract thoroughly before signing it.
